Foresight Software, Inc. ("Foresight," "we," "our," or "us") respects your privacy. This privacy policy applies to all of our platforms and services, including our commercial website, application products, AI-powered analytics and processing services, data integrations and connectors, administrative tools, assessment portals and tools, APIs, and surveys, assessments, and questionnaires (collectively, our "Services"). This privacy policy describes what personal information we collect from you, how we use and share it, and your rights and choices regarding your information, including whether or not to share it with us.
By accessing our Services, you agree to this privacy policy. If you do not agree to be bound by this policy, you may choose not to access or use our Services. Additional specific policies or agreements may apply to certain of our Services, including our Data Processing Agreement for enterprise customers. If such policies or agreements conflict with this policy, the terms of those policies or agreements will prevail.
Types of Information We Collect
It is your decision whether to provide information that we request. Please know that, if you choose not to provide personal information, we may not be able to provide you with a relevant service or feature of our Services. Below are the types of information we may collect about you.
Personal Information
Personal information is information that identifies or is capable of identifying you as an individual. We collect personal information from you when you voluntarily provide it to us, such as by creating a user account, ordering or subscribing to our products or services, participating in or completing a survey, assessment, or questionnaire, or corresponding with us. We also may collect personal information about you from your use of our products and services or through our partners and other publicly and commercially available sources. Personal information we collect from you may include:
- Contact information such as name, email address, mailing address, and phone number;
- Log-in information such as username and password; and
- Other information you choose to provide, such as assessment responses, comments, questions, and requests.
You agree not to provide through use of our Services any sensitive personal information, including information relating to medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or sexuality.
Customer Interaction Data
When our customers use our platform, we may process data from third-party sources integrated with our Services, including call recordings and transcripts, customer relationship management (CRM) records, support tickets, and meeting metadata. This data may contain personal information about our customers' end users, employees, or contacts. We process this data on behalf of and under the direction of our customers, who act as the data controllers for such information. Our customers are responsible for ensuring they have appropriate legal bases and consents for sharing this data with us.
AI-Derived Data
Our platform uses artificial intelligence and machine learning to generate insights, scores, and analytical outputs from data provided by or on behalf of our customers. These derived outputs are generated through automated processing and may include value realization assessments, sentiment analysis, trend identification, and recommendations. AI-derived data is owned by the applicable customer pursuant to their service agreement.
Cookies and Similar Technologies
We and our partners use cookies and similar technologies on our Services. Cookies are text files we place on your computer or device browser to store your preferences. Information that may be collected through the use of these technologies includes the Internet Protocol address automatically assigned to your computer, your browser type, the date and time of your visit, the pages you visit and the amount of time spent on each, your device's operating system, your mobile device identifier, your geographical area, referring URLs, and other information on your interaction with our Services.

Aggregate and Anonymous Information

You acknowledge that it may take up to 10 days for us to process an opt-out request. Please note that you cannot opt out of receiving transactional emails related to your account with us.

- To customize our Services for each individual visitor;

Artificial Intelligence and Automated Processing
Our platform employs artificial intelligence ("AI") and automated processing technologies to deliver our Services.
How We Use AI
We use AI to analyze customer interaction data, including call transcripts and meeting notes, to extract value signals, identify patterns, assess sentiment, and generate reports and recommendations. Our AI processing is designed to support human decision-making and does not make autonomous decisions that produce legal or similarly significant effects on individuals.
AI Sub-processors
We use third-party AI infrastructure providers to power our automated processing capabilities. Customer data processed through these providers is subject to our data processing agreements and is not used by such providers to train, improve, or develop their general-purpose AI models. A current list of AI sub-processors is available upon request.
Data and Model Training
We do not use customer data to train or fine-tune AI models available to other customers or third parties. Any use of aggregate, de-identified data for improving our platform's AI capabilities is done in accordance with applicable laws and our customer agreements.
Human Oversight
You may request human review of any output or decision generated through our automated processing by contacting us at the information provided below.
Our Role in Processing Your Information
When you interact with our website, create an account, or communicate with us directly, Foresight Software, Inc. acts as the data controller for your personal information.
When we process data on behalf of our enterprise customers through our platform — including call transcripts, CRM data, and other customer-provided information — we act as a data processor under the direction of our customer, who serves as the data controller. Our obligations as a data processor are governed by our Data Processing Agreement (DPA), which is available upon request.
If you are an individual whose data has been processed through our platform on behalf of one of our customers, please direct any data subject requests to the relevant Foresight customer (the data controller).
Disclosure of Your Information
We will not trade, sell, or share your personal information for use by any business without your consent, unless required by law or as disclosed to you when the information is collected. We may share your personal information with others in the following instances:
- When legally required to do so;
- At the request of governmental authorities conducting an investigation;
- To verify or enforce compliance with the policies governing our Services and applicable laws; and
- To a successor entity in connection with a corporate merger, consolidation, sale of assets, or other corporate change.
Third-Party Vendors and Sub-processors
We may share your personal information with third-party agents, contractors, service providers, and suppliers who assist in providing support and services to our entities. When we do so, we require those third parties to protect your personal information in accordance with this policy and applicable laws.
We maintain a list of sub-processors who may process personal information on our behalf. Enterprise customers may request a current copy of our sub-processor list and may subscribe to notifications of changes. We will provide at least 30 days' advance notice before engaging a new sub-processor that processes customer data.
International Transfers of Personal Information
Our Services are based in the United States of America and are subject to the laws of the United States. If you are a user outside of the United States, please know that any information you provide on our Services may be transferred to the United States.
When we transfer personal data from the European Economic Area or the United Kingdom, we will ensure such transfers are in compliance with relevant data protection laws, including through the use of Standard Contractual Clauses or other approved transfer mechanisms.
How We Protect Your Information
We implement a variety of security measures when you enter, submit, or access your information to maintain the safety of your personal information. Our security measures include: encryption of data in transit (TLS 1.2 or higher) and at rest, access controls based on the principle of least privilege, regular security assessments, employee security awareness training, and incident response procedures.
Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential.
How Long We Retain Your Information
- Account information: Retained for the duration of your active account, plus 90 days following closure or termination.
- Customer interaction data: Retained as directed by the applicable customer and deleted within 90 days of a deletion request or contract termination.
- AI-derived insights and reports: Retained for the duration of the applicable service agreement and deleted within 90 days of termination.
- Marketing and analytics data: Retained for up to 24 months from collection or last interaction.
- Backup copies: May be retained for up to 30 additional days for disaster recovery purposes.
Legal Basis for Use of Your Personal Information (GDPR)
If the GDPR applies to your personal information, our legal basis for collecting and using it will depend on the context, including: legitimate business purposes, necessity to provide products and services, your consent, compliance with applicable laws, or legitimate and overriding interest.
Children's Privacy
Our Services are not intended for or designed to attract children under the age of 18, and we will not knowingly solicit or collect personal information from children we actually know are under 18.
Your Rights and How to Exercise Them
Depending on your location and applicable law, you may have the following rights:
- Right to access / know: Request a copy of the personal information we hold about you.
- Right to correct / rectify: Request that we correct or update inaccurate information.
- Right to delete / erase: Request that we delete your personal information.
- Right to data portability: Request your information in a structured, machine-readable format.
- Right to restrict processing: Request that we limit processing under certain circumstances.
- Right to object: Object to processing based on legitimate interests.
- Right to opt out of sale/sharing: We do not sell your personal information to third parties.
- Right to opt out of automated decision-making: Request human review of automated decisions.

We do not sell your personal information to third parties.
Do Not Track
We currently do not respond to any Do Not Track signals or similar signals.
Data Processing Agreement
For enterprise customers, our Data Processing Agreement (DPA) governs our processing of personal data on your behalf and supplements this Privacy Policy. To request a copy of our DPA, please contact us.
Modification of Our Privacy Policy
We may modify our privacy policy from time to time. When we modify our privacy policy, we will notify you by a posting on our Services. We urge you to review this privacy policy often so you are always fully informed.
